Hamo AI Terms of Service

1. Acceptance of Terms
By creating an account or using Hamo AI (the “Service”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.
These Terms apply to individual consumers. Institutional partners (employers, clinics, schools) are governed by a separate Master Services Agreement (the “MSA”), which incorporates these Terms by reference and adds institutional-specific provisions.
You must be at least 16 years of age to use the Service in Canada and the United States, or 18 years of age in jurisdictions where the contractual age of majority is higher. Users under 18 should use the Service only with the involvement of a parent or guardian.
2. What Hamo AI Is — And Is Not
Hamo AI is an AI-mediated mental wellness companion designed to support self-reflection, emotional regulation, and engagement with evidence-informed therapeutic frameworks (Cognitive Behavioural Therapy, Acceptance and Commitment Therapy, mindfulness-based approaches).
Hamo AI is not:
- a medical device under the Food and Drugs Act (Canada) or analogous legislation;
- a substitute for licensed mental-health care;
- a licensed therapist, psychiatrist, psychologist, or social worker;
- an emergency service.
The Service does not establish a clinical doctor-patient relationship between you and Hamo AI Technology Ltd. It establishes a software service relationship.
If you are experiencing a mental-health crisis, contact the appropriate emergency service in your country (911 in Canada and the United States; 120 in mainland China). Hamo AI displays these numbers in the application but cannot place calls on your behalf.
3. Your Account
3.1 Registration
You agree to provide accurate information during registration and to keep it current. You are responsible for safeguarding your password and for all activity under your account.
3.2 Multi-Factor Authentication
The Service enforces email-based MFA for all logins (PHIPA 6.1.4 compliant). You must maintain access to the email address registered to your account. Loss of email access may result in temporary or permanent account inaccessibility.
3.3 Account Termination by You
You may delete your account at any time through Settings → Delete Account. Deletion requires email-verification to confirm intent. Upon deletion, the Service will:
- mark your account as deleted within 24 hours;
- stop all further data collection;
- comply with the Data Retention and Deletion terms in §8.
4. Acceptable Use
You agree not to use the Service to:
- generate, distribute, or solicit content that is illegal, violent, sexually explicit, or hateful;
- impersonate another person, including a clinician;
- attempt to reverse-engineer, decompile, or interfere with the Service's operation;
- use automated tools (bots, scrapers) to access the Service;
- resell or sublicense access to the Service.
We may suspend or terminate accounts that, in our reasonable judgment, violate these provisions. We will provide notice and an opportunity to cure where doing so does not jeopardize the safety or rights of other users.
5. AI Output — Limitations
The Service uses large language models (currently the Google Gemini family) to produce conversational responses. AI output may be inaccurate, incomplete, or contextually inappropriate. You should not rely on AI output as the sole basis for any clinical, medical, legal, financial, or life decision.
We have implemented industry-standard safeguards including:
- a documented Crisis Escalation Protocol (see §9);
- output filtering against demonstrably unsafe content;
- a Chain-of-Verification post-generation check designed to remove unsupported claims;
- mandatory language enforcement so the AI responds in your selected language.
These safeguards reduce — but do not eliminate — the risk of unsafe or unhelpful output. You acknowledge this limitation.
6. Crisis Disclosures
If during your use of the Service you express signals of acute self-harm, suicidal ideation, or dangerous drug use, the Service will:
- display an immediate, region-specific crisis hotline banner;
- replace the next AI response with a fixed safety message;
- notify the human therapist or clinician assigned to your account, where one exists.
The full protocol is published as a versioned document in our public repository. You consent to this protocol by using the Service.
If your account is sponsored by an institutional partner (e.g., your employer's EAP program), the partner may, with your explicit opt-in consent, also receive a notification containing only the event type and timestamp — never conversation content. You may revoke this consent at any time in Settings → Privacy.
7. Subscription and Billing
7.1 Plans
The Service is offered under tiered plans (Standard, Premium) with features and limits described on our pricing page. A 3-day free trial is provided after sign-up.
7.2 Billing
Subscriptions auto-renew at the end of each billing cycle unless cancelled. We accept payment via the methods listed at checkout. Failed payments may result in service suspension after a 7-day grace period.
7.3 Refunds
We do not provide refunds for partial billing periods. We will refund full billing periods if requested in writing within 14 days of the charge and you have not initiated more than 3 chat sessions in that period.
7.4 Price Changes
We may change pricing with at least 30 days' notice via email and in-app notification. Changes apply at your next billing cycle.
8. Privacy, Data, and Your Rights
8.1 Data Ownership
You own your conversation data. Hamo AI Technology Ltd. acts as a data processor, not an owner, of personal information you provide.
8.2 Privacy Policy
Detailed handling, retention, and processing of personal information is governed by our Privacy Policy, incorporated by reference.
8.3 PIPEDA / PHIPA / Provincial Health Privacy Rights
You have the right to:
- Access: request a copy of personal information we hold about you (response within 30 days, free of charge);
- Correct: request corrections to inaccurate personal information;
- Delete: request deletion of your account and associated data (response within 7 business days for active deletion; longer for irrevocable deletion of replicated backups, capped at 90 days);
- Export: receive a machine-readable export of your conversation history (delivered within 14 days);
- Withdraw consent: at any time, with the effect described in §6 (institutional notification) or in the Privacy Policy (analytics, marketing).
Submit requests to privacy@hamo.ai. We will not retaliate for exercising these rights.
8.4 Audit-Log Retention
For regulatory and safety reasons, certain audit records — specifically MFA verification logs, crisis-event metadata (anonymized after account deletion), and access logs — are retained for the period required by applicable law, typically 7 years. These records are encrypted at rest using AWS KMS Customer-Managed Keys.
9. Crisis Escalation Protocol — Incorporated by Reference
By using the Service you acknowledge and consent to the operation of the Crisis Escalation Protocol described in §6 above. The Protocol is part of these Terms.
We may update the Protocol from time to time to reflect improved detection methods, expanded country coverage, or regulatory feedback. Material changes will be communicated with at least 30 days' notice.
10. Disclaimers and Limitation of Liability
10.1 Service Provided “As Available”
The Service is provided “as available”, with reasonable commercial efforts toward uptime and accuracy. We do not warrant that the Service will be uninterrupted, error-free, or fit for any particular purpose beyond what is expressly stated in these Terms.
10.2 Liability Cap
Except for liabilities listed in §10.3, our total cumulative liability to you arising from your use of the Service in any 12-month period shall not exceed twelve (12) times the subscription fees you paid to us in that period, or CAD $1,000, whichever is greater.
This cap applies to all theories of liability — contract, tort, statute, or otherwise — to the fullest extent permitted by applicable law.
10.3 Carve-Outs (No Cap)
The cap in §10.2 does not apply to:
- our gross negligence;
- our willful misconduct;
- our fraud or fraudulent misrepresentation;
- liabilities that cannot be limited under applicable law (e.g., death or personal injury caused by our negligence in jurisdictions where such limitation is prohibited);
- our breach of confidentiality or data-protection obligations under §8;
- our indemnity obligations under §11 (if any).
10.4 No Liability for AI Output Decisions
Subject to §10.3, we are not liable for decisions you make based on AI output. The Service is designed to support, not replace, your own judgment and the advice of qualified human professionals.
10.5 Force Majeure
Neither party is liable for delays or failures caused by events outside reasonable control: natural disasters, war, government action, internet/utility outages, or actions of upstream providers (Google Gemini, AWS).
11. Indemnification
You agree to defend Hamo AI Technology Ltd. against third-party claims arising from your (a) breach of §4 Acceptable Use, (b) infringement of third-party intellectual property by content you provided, or (c) unlawful conduct, and to pay damages and reasonable legal fees finally awarded.
We will defend you against third-party claims that the unmodified Service (excluding content you provided) infringes a third party's intellectual property right, and pay damages and reasonable legal fees finally awarded, subject to the cap in §10.2.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email and via in-app banner at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance. If you do not agree, you may terminate your account under §3.3 with no further obligation.
13. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles. The federal laws of Canada apply where mandatory.
Disputes will first be addressed in good faith by direct negotiation between the parties. If unresolved within 60 days, disputes will be submitted to non-binding mediation in Toronto, Ontario, before escalating to court proceedings.
Notwithstanding the above, either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property, confidentiality, or data-protection interests.
You agree not to participate in class-action litigation against us, to the extent such waiver is permitted under applicable law.
14. Miscellaneous
14.1 Entire Agreement
These Terms (together with the Privacy Policy and the Crisis Escalation Protocol) constitute the entire agreement between you and Hamo AI Technology Ltd. regarding consumer use of the Service.
14.2 Severability
If any provision is held unenforceable, the remainder remains in effect.
14.3 No Waiver
A failure to enforce any provision does not waive future enforcement.
14.4 Assignment
You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of substantially all our assets, subject to the new owner's commitment to honour these Terms.
